Esano seller terms in plain language

When you open a shop, you agree to Esano's Retailer Terms and Conditions, the DMCA Policy and the Terms of Use. The Retailer terms control if they conflict with the Terms of Use. The binding text is at esano.com/terms-of-use. This article summarizes it.

What Esano gives you

Esano lets you distribute your products through the marketplace as long as you keep following the terms. Esano is a marketplace and venue. It doesn't control shops or the products they sell, and no employment or partnership is created between you and Esano.

What you promise

  • Your products are yours to sell. You own them or hold the licenses needed to sell them without anyone else's approval. See original work requirements for sellers.
  • You're based in the United States or its territories. For now, shop setup only accepts United States as your country of residence, with a US Stripe account. See who can sell on Esano.
  • You follow the content standards in the Terms of Use for every product and every conversation with users. See what's not allowed on Esano.
  • You keep up good service. The terms ask for a high standard of customer service and product quality, as Esano determines, and prompt answers to customer questions and disputes, including questions from Esano.
  • You follow DMCA takedown notices and other removal requests from Esano.
  • You keep a working email. Esano sends all notices to the email on your account, and the terms make it your duty to monitor it.

What Esano can use

During your time as a seller, you give Esano a limited, non-exclusive, royalty-free license to use your product images, descriptions and marks to distribute and promote your products. You keep ownership of your products, images, descriptions and marks.

Account and payout setup

To authorize you, Esano needs your first and last name, a tax ID for 1099-K reporting and a valid email address. You also connect a Stripe account. See What you need to open a shop and Connect Stripe to get paid.

Fees and payouts in the terms

Opening and running a shop is free. There's no monthly subscription, listing fee, expiry or renewal fee. Esano keeps 20% of each item price when you sell. Earnings have a 14-day hold. Money owed and removals

  • If a payment was sent to you by mistake, or you keep money that should go to a customer, Esano can refund the customer and recover the money from you, even after it paid you.
  • If Esano removes any of your products for any reason, the fees Esano already received stay with Esano.
  • You agree to cover Esano against claims that come from your breach of the terms, including claims that your products infringe someone else's rights.

Ending the relationship

Either you or Esano can end it at any time for any reason. Until it ends, you must follow all Esano policies.

Where these terms stop

Esano isn't liable for defects in your products or for lost profits from your use of the site. If Esano has to defend or pursue a claim under the Retailer terms and wins, you pay its reasonable attorney fees and costs.

Common questions

Can I close my shop whenever I want?

Yes. Either side can end the relationship at any time for any reason. To end it, email customerservice@esano.com.

Is a seller an Esano employee?

No. The terms say no agency, partnership or joint venture is created. You and Esano are independent contractors.
