What you agree to when you use Esano

The Terms of Use are an agreement between you and Esano, L.L.C. They cover your use of esano.com, including everything you can see, buy or sell there. Using the site means you also accept these documents, which are part of the terms:

• Terms and Conditions for Online Sales
• Retailer Terms and Conditions, if you are a seller

Using the website

The site is for your personal, non-commercial use, except that sellers may use it to sell. You may not copy, republish, modify or resell material from the site, or remove copyright notices from it. If you bought a product, you may use it for non-resale purposes.

Esano can withdraw or change the website, or any service on it, at any time without notice. Esano can also restrict access to parts of the site or the whole site.

Keeping your account secure

• Give correct, current and complete information when you register.
• Keep your username, password and other sign-in details confidential.
• Your account is personal to you. Don't let anyone else use it.
• Tell Esano right away if you notice unauthorized use of your account.
• Sign out at the end of a session, especially on a shared computer.

What you can't do

The terms ban unlawful use, impersonation, spam, scraping, and anything that harms the site or other people. They also set content standards for everything on the marketplace. See what's not allowed on Esano.

What you post is your responsibility

Anything you post on Esano is treated as non-confidential and non-proprietary. You give Esano and its service providers the right to use, reproduce, modify, display and distribute it. You promise that you own or control the rights to it and that it follows the terms. You are responsible for what you post, including whether it is legal, accurate and appropriate.

Esano doesn't review everything before it appears. The terms say Esano can't guarantee that objectionable material will be removed promptly.

Other people's content and links

Statements and opinions from other users and sellers are their own, not Esano's. Esano isn't responsible for the accuracy of third-party materials, including what sellers say. Links to other sites, including seller websites, are at your own risk.

Downloads, warranties and liability

The terms say the site and the products on it are provided "as is" and "as available." Esano can't guarantee that any download is free of viruses or will work as intended, and the terms say you are responsible for your own antivirus protection and backups.

The terms also limit Esano's liability. In cases the broader exclusions don't cover, the cap is the greater of $100 or what you paid Esano in the last six months for the product or service involved. You also agree to defend and cover Esano against claims arising from your violation of the terms or your use of the site.

Law and disputes

The terms are governed by Oklahoma law. Court cases must be filed in the District Court of Oklahoma County, Oklahoma. A claim must be started within one year after it arises. You waive your right to a jury trial, and claims are tried to a judge. The Online Sales terms add a class action waiver for purchase claims.
