How Esano updates its terms

Updated

Esano can update its terms at any time. Changes to the Terms of Use take effect as soon as they are posted, and fee changes for sellers come with at least 14 days' notice. The current text is always at esano.com/terms-of-use.

Terms of Use

The Terms of Use say Esano may revise and update them from time to time in its sole discretion. Changes:

  • Take effect immediately when they are posted.
  • Apply to all access to and use of the website after that.
  • Count as accepted if you keep using the website.

You are expected to check the page from time to time, because the changes bind you. See Esano Terms of Use in plain language.

Terms and Conditions for Online Sales

These terms can change without prior written notice at any time. Changes are in effect as of the "Last Updated Date" shown on the website. The terms ask you to review them before you buy.

Retailer Terms and Conditions

The Retailer terms are part of the Terms of Use, so the same rule applies. Two points are specific to sellers:

  • Fee changes: sellers get at least 14 days' notice before any platform fee changes. See What fees does Esano charge sellers?.
  • Notices: Esano sends notices to the email on your seller account. The terms say it is your duty to maintain and monitor that email.

When you open a shop, you accept a specific version of the seller terms. The sign-up flow shows the version number and asks you to confirm that you have read and agree to the seller terms and the fees shown. See Esano seller terms in plain language.

How to see when something changed

Each section of the terms page ends with a date, labeled "Last Modified" or "Last Updated." Check it to see when that section last changed. The terms page has four parts:

  1. Website Terms of Use
  2. Terms and Conditions for Online Sales
  3. Retailer Terms and Conditions
  4. Copyright (DMCA) Policy

The Privacy Policy is a separate page. See How Esano uses and shares your data.

What if the documents disagree

The terms set an order of precedence:

  • For purchases, the Online Sales terms apply over the Terms of Use if they conflict.
  • For sellers, the Retailer terms control over the Terms of Use if they conflict.
  • In general, a document incorporated by reference takes precedence over the Terms of Use in interpretation.

Together, the Terms of Use and the documents they incorporate are the entire agreement between you and Esano about the website.

If you don't agree with a change

The terms say that if you don't agree to the Terms of Use, you must not access or use the website. Sellers can end the relationship at any time by emailing customerservice@esano.com. See what happens when a shop is suspended or closed.
