What happens when Esano's rules are broken

If someone breaks the Terms of Use, Esano can remove their content, disable their sign-in, and suspend or end their access. It can also report illegal activity to law enforcement. The binding text is at esano.com/terms-of-use.

What Esano can do

Under the Monitoring and Enforcement section of the Terms of Use, Esano has the right to:

  • Remove or refuse to post anything you submit, for any or no reason, in its sole discretion.
  • Take any action it considers necessary on content it believes breaks the terms, infringes someone's rights, threatens anyone's safety, or could create liability for Esano.
  • Disable any username, password or other identifier at any time, including if it believes you violated the terms.
  • Suspend or end your access to all or part of the website, for any or no reason, including a violation of the terms.
  • Share your identity or information with a third party who claims your material violates their rights, such as their intellectual property or privacy.
  • Take legal action, including referral to law enforcement, for illegal or unauthorized use. Esano can also cooperate with law enforcement or a court order.

The terms say Esano doesn't review everything before it is posted and can't ensure objectionable material comes down right away. If you spot something, see Report a listing or shop.

What this looks like for sellers

Seller terms you accept when opening a shop say Esano may remove listings that break marketplace policies and may pause shops that repeatedly do. A shop can be hidden, suspended or closed, and a single listing can be removed and can't be published again (see What listing statuses mean). Seller hub shows a notice with the reason Esano gave.

Esano's policy is to follow applicable intellectual property laws and to terminate the accounts of repeat infringers. Sellers also promise to follow DMCA takedown notices and other removal requests from Esano. See original work rules for sellers and What happens to repeat infringers.

Fees and money

  • If Esano removes any seller's products for any reason, the fees Esano already received stay with Esano.
  • If a seller was paid by mistake, or keeps money that should go back to a customer, Esano can refund the customer and recover it from the seller, even after paying them.
  • Ending a seller's account doesn't cancel amounts owed, refund obligations or records.

You are still responsible

You agree to cover Esano against claims that come from your violation of the terms or your use of the site. You also waive claims against Esano and its providers over actions taken during, or because of, their investigations or law enforcement's investigations.

Common questions

Will Esano warn me before removing something?

The terms don't promise a warning. Esano can remove content, and can suspend or end access, for any or no reason in its sole discretion, including a violation of the terms.

Can a removed listing be put back up?

A listing that Esano removes from the marketplace can't be published again by the seller. If you think it was a mistake, contact Esano.
