Buyer terms for online purchases

Updated

When you buy on Esano, your order is an offer to the shop, the shop must accept it, and once accepted you can't cancel it. You buy for personal or household use, and refunds follow Esano's published refund rules. The binding text is the Terms and Conditions for Online Sales on esano.com.

How orders work

Esano is a marketplace. Independent shops, called Retailers in the terms, sell the files.

  • Your order is an offer to buy from a specific shop.
  • The shop has to accept the order. Without that, Esano isn't obligated to make sure you get the products.
  • After the order is accepted, you can't cancel it.

Prices, taxes and payment

  • Prices and promotions are set by shops and can change without notice. You pay the price in effect when you place the order. It appears in your order confirmation email.
  • Posted prices don't include taxes. Taxes are added at checkout and itemized in your cart and confirmation email.
  • Esano may run promotions with separate terms. If they conflict with the sales terms, the promotion terms apply.
  • Stripe processes all payments. When you pay, you confirm that your card information is true and complete and that you're authorized to use the card.

More detail is in fee and payment rules in Esano's terms, payment methods and currency and sales tax at checkout.

Refunds

The sales terms include Esano's refund rules. In short, for ready-made downloads you can request a voluntary refund within seven days of purchase through Purchases and reviews. Change of mind isn't covered by that voluntary policy. Mandatory consumer rights still apply. Custom orders have their own rules. See Esano's refund policy for digital files and How custom orders work for the full steps and deadlines.

Personal or household use only

You promise that you are buying for your own personal or household use, not for resale or export. You also promise that your purchase will be delivered to a location in the United States or its territories. Each listing's license says what you can do with the files. See Esano license types explained.

What Esano doesn't promise

  • Esano doesn't design, write, make or control the products shops sell.
  • Having a product on the site doesn't mean Esano endorses it or the shop.
  • Products are provided "as is," with no warranties from Esano.
  • The terms say Esano isn't liable for a shop's failure to honor its obligations to you.

These terms are why a problem with a file starts with the refund process and the shop, not a product warranty. See liability, law and disputes in Esano's terms.

Disputes

You and Esano agree to give up the right to a jury trial and to join a class or representative action. Claims about your purchases are decided one by one by a judge. The terms also say that if Esano has to defend or pursue a claim and wins, you pay its reasonable attorney fees and costs.

Who the terms cover

The terms don't give rights to anyone other than you. They apply together with the Terms of Use, and where the two conflict, the Online Sales terms apply.

Common questions

Can I cancel an order after the shop accepts it?

Not under the Online Sales terms. Once the shop accepts your order, you can't cancel it. Refund rules still apply, and mandatory consumer rights are not removed.

Can I resell the files I buy?

No. The terms say you are buying for your own personal or household use, not for resale or export.
