What happens when a listing is reported

Updated

When a listing is removed for infringement, it disappears from the marketplace and its seller sees Removed by Esano in their dashboard. The seller can't publish it again, but can respond with a counter notice if the removal was a mistake.

What buyers see

A removed listing is taken off every public page. That includes its listing page, search results, the cart and checkout. Nobody can add it to a cart or buy it while it is removed. Its images stop being served as well.

What the seller sees

If your listing is removed, you will see these signs:

  • A Removed by Esano label on the listing under Listings in your seller dashboard.
  • A message on the listing that reads "Esano removed this listing from the marketplace," followed by the reason Esano gave.
  • A statement that the listing can't be published again.

You can still open the listing, edit it or unpublish it. You can't set it live again. See What listing statuses mean.

Esano sends notices to the email address on your seller account. Its Retailer Terms say all notices go to that address, and that it's your job to keep it current and check it. Keep it working so you don't miss a notice.

When the whole shop is affected

Esano can also hide, suspend or close a shop. While that is in place, you'll see a notice on every page of your seller dashboard with the reason. See Why Esano hid, suspended or closed your shop for what happens to orders and money.

  • Hidden: The shop and its listings are off the marketplace for now. You can keep working on your listings.
  • Suspended: Listings are off the marketplace, and you can't publish or edit listings or send messages.
  • Closed: The listings are unpublished. Your orders, payouts and reviews are kept.

What to do if you think it was a mistake

  1. Read the reason shown on the listing.
  2. Decide whether you own the work or have the rights to sell it.
  3. If you do, send a counter notice to Esano's copyright agent. See How to file a DMCA counter notice.
  4. If you don't, don't relist the same work under a new listing. Repeat copying can lead to account termination. See What happens to repeat infringers.

Why Esano can remove a listing

Esano's terms let it remove or refuse content for any reason or no reason, and take action on content it believes infringes anyone's intellectual property rights. It doesn't need to wait for a formal notice. It also says it can't review all material before posting.

The Retailer Terms add that a seller promises to follow Esano's DMCA take-down notices and other requests.
