How to report copyright infringement

To report a copied design, send a written DMCA notice to Esano's designated copyright agent. The notice has to include seven items, listed below. Notices that miss requirements may not be effective.

Before you send a notice

  • Confirm that you own the copyright, or that you're authorized to act for the owner.
  • Make sure you can point to the exact listing. Copy its link from your browser.
  • Read the warning at the end of this article. Misrepresenting a claim can have legal costs.

What your notice must include

Under Esano's DMCA policy and 17 U.S.C. § 512, your written notice must include substantially all of the following:

  1. Your signature. A physical or electronic signature.
  2. The copyrighted work. Identify the work you believe was infringed. If the claim involves several works on Esano, include a representative list.
  3. The infringing material. Identify it precisely enough for Esano to find it. A link to the listing is the clearest way. Add the listing title and shop name.
  4. Your contact information. Your name, postal address and telephone number, and your email address if you have one.
  5. A good faith statement. Say that you believe in good faith that the use of the copyrighted material is not authorized by the copyright owner, its agent or the law.
  6. An accuracy statement. Say that the information in your notice is accurate.
  7. An authority statement. Say, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

What happens next

Esano's policy doesn't give a response time, so this article doesn't promise one.

The terms also let Esano disclose a poster's identity or information to a third party who claims the poster's material violates their rights.

The warning in the policy

If you knowingly and materially misrepresent that material or activity on Esano is infringing your copyright, you may be held liable for damages, including costs and attorneys' fees, under Section 512(f) of the DMCA. Only send a notice you can stand behind.

Can I report copying by email?

Esano's policy asks for written notification sent to its designated copyright agent. The agent's email address and postal address are listed in the policy and in this article.

What if I'm not the copyright owner?

A notice has to state under penalty of perjury that you are authorized to act on behalf of the copyright owner. If you aren't the owner or their agent, don't send one.
